Please read these Terms of Service ("Terms") carefully before using the Adigator platform operated by Adigator ("we", "our", or "us"). By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Acceptance of Terms

By creating an account or using any part of the Adigator platform, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and agree to these Terms and our Privacy Policy.

2. Description of Service

Adigator is an AI-powered ad creative generation platform. Users submit brand information (including website URLs and brand assets), and the platform uses artificial intelligence to generate advertising creatives suitable for use on platforms such as Meta (Facebook & Instagram), Google, and others. The platform operates on a credit-based system.

3. Account Registration & Responsibilities

• You must provide accurate, current, and complete information when registering.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at hello@adigator.ai if you suspect unauthorised access to your account.
• You may not share your account with others or create multiple accounts to circumvent credit limits.

4. Credit System & Usage

• Access to ad creative generation is governed by a credit system. Credits are consumed each time a creative is generated.
• Credits are purchased through our platform and are non-refundable unless otherwise stated.
• Unused credits do not roll over beyond the period specified in your plan unless explicitly stated.
• We reserve the right to modify credit pricing and allocation with reasonable notice.
• Fraudulent use of credits or payment methods will result in immediate account termination.

5. Acceptable Use Policy

You agree to use Adigator only for lawful purposes. You must not use the platform to:

• Generate content that is illegal, defamatory, obscene, hateful, or discriminatory.
• Infringe upon the intellectual property rights of any third party.
• Create misleading, deceptive, or fraudulent advertising.
• Violate Meta Platform Policies, Google Ads policies, or any applicable advertising platform guidelines.
• Attempt to reverse-engineer, scrape, or extract data from the platform in an unauthorised manner.
• Introduce malware, viruses, or any harmful code.
• Impersonate any person or entity.
• Use the platform in any way that could damage, disable, or impair its operation.

We reserve the right to suspend or terminate accounts that violate this policy at our sole discretion.

6. Intellectual Property

Your Content: You retain all ownership rights to your brand assets, logos, images, and other materials you upload to the platform ("User Content"). By uploading User Content, you grant Adigator a limited, non-exclusive licence to use that content solely for the purpose of generating your ad creatives.

Generated Creatives: Ad creatives generated using your brand assets and credits are owned by you, subject to any third-party AI model licences. You are responsible for ensuring generated creatives comply with applicable advertising platform policies before use.

Platform: Adigator retains all rights to the platform, including its software, algorithms, design, trademarks, and underlying technology. Nothing in these Terms transfers any platform intellectual property to you.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CREATIVES WILL MEET YOUR SPECIFIC REQUIREMENTS OR ACHIEVE ANY PARTICULAR ADVERTISING RESULT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADIGATOR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Termination

You may terminate your account at any time by contacting us at hello@adigator.ai.

We reserve the right to suspend or terminate your account and access to the platform at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the integrity of the platform. Upon termination, your right to use the platform ceases immediately. Unused credits are non-refundable upon termination for cause.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.
